Purpose: The primary objective of this study was to determine the role of church in state and public affairs during the Kibaki Era, 2002-2013Methodology: The methodology employed in this study was qualitative in nature. The study relied mainly on the analysis of an existing dataset from secondary sources. The data was gathered from technical reports, scholarly journals, reference books, past sermons, church publications, official and unofficial doctrine, theologies and from the Kenya National Archives in Nairobi. Other sources of data collection (...) for the study included official statistics collected by government and the various agencies, bureaus and departments. The target population for this study was the mainland churches in Kenya and the role these churches played in state and public affairs in Kenya between 2002 and 2007.Results: The Kibaki era has been characterized by many an events that have attracted by far and wide the attention of the clergy. In 2005, the most significant development of the 2005 constitutional referendum is not the defeat of the draft, but the emergence of strains and tensions not just between Christians and Muslims, but also between church and state. Another significant development was the fact that the mainline clergy were increasingly viewed as partisan and divided along ethnic lines and serving narrow political interest depending on the ethnic group to which its leaders belonged. The prophetic role and voice of the church to act as the conscience of society was lost, and the church did nothing to evaluate its own role even after the people voted to soundly reject the draft constitution.Unique contribution to Theory, Practice and Policy: The study recommended that the government should put in place laws that would involve the church in government matters. This can be done by introducing motions into parliament that advocate for the direct involvement of the church. This would involve laws which ensure that a portion of all members sitting in any committee represents the church. This can also be done by the introduction of electoral posts for church representatives just as there are positions for women representatives. The study also recommends that amendments be made to the constitution to make a legal requirement that one of the nominated MPs must be from the church. (shrink)

Theories of quantum gravity generically presuppose or predict that the reality underlying relativistic spacetimes they are describing is significantly non-spatiotemporal. On pain of empirical incoherence, approaches to quantum gravity must establish how relativistic spacetime emerges from their non-spatiotemporal structures. We argue that in order to secure this emergence, it is sufficient to establish that only those features of relativistic spacetimes functionally relevant in producing empirical evidence must be recovered. In order to complete this task, an account must be given of (...) how the more fundamental structures instantiate these functional roles. We illustrate the general idea in the context of causal set theory and loop quantum gravity, two prominent approaches to quantum gravity. (shrink)

This study develops a genetic phenomenological sociology of space from the phenomenology and phenomenological sociology of space. Based on relational ontology, it argues that social space is a social relationship in genesis. An Apple walk-in store and an Apple online store are examples to illustrate the essence of social space. Any Apple store as a social space represents a set of social relations. The genetic phenomenological sociology of space in both store types includes two parts: first, the social ontology of (...) space, that is, ‘being-in-the-Apple-store’ or ‘being-in-the-Apple-online-store’; and second, the social epistemology of space, that is, the act of ‘encountering’ in either store. Examining the existence of space ontologically and the mode of existence epistemologically clarifies that the actual ‘meaning’ of social space, an Apple store or an Apple online store in this study, emerges through the act of encountering. Three characteristics of encountering are placelessness, ‘de-distancing,’ and mediation. (shrink)

Scientific models need to be investigated if they are to provide valuable information about the systems they represent. Surprisingly, the epistemological question of what enables this investigation has hardly been investigated. Even authors who consider the inferential role of models as central, like Hughes or Bueno and Colyvan, content themselves with claiming that models contain mathematical resources that provide inferential power. We claim that these notions require further analysis and argue that mathematical formalisms contribute to this inferential role. We characterize (...) formalisms, illustrate how they extend our mathematical resources, and highlight how distinct formalisms offer various inferential affordances. (shrink)

This article offers a unified theory of the licensing of Negative and Positive Polarity Items, focusing on the acceptability conditions of PPIs of the some-type, and NPIs of the any-type. It argues that licensing has both a syntactic and a semantic component. On the syntactic side, the acceptability of PIs is checked in constituents; in fact, for any given PI, only some constituents, referred to as `domains', are eligible for the evaluation of that PI. The semantic dimension of licensing consists (...) in the sensitivity of PIs to the monotonicity properties of the syntactic environments they find themselves in. Two pieces of evidence support the semantic dimension of what I call the ‘environment-based’ approach defended here: PIs are subject to flip-flop and certain inferences affect their acceptability by modifying the monotonicity of their environment. A third property, called ‘entanglement’ and so far unnoticed, is described: the acceptability of PIs depends on the acceptability of other PIs in the same syntactic environment. The latter property is exploited to determine what semantic property some is sensitive to: it turns out that, contrary to the consensus among researchers, some is acceptable in the complement of the set of environments in which any is acceptable, and vice versa. Ontic structuralism or ontic structural realism in the philosophy of physics can be broadly considered as an interpretative strategy providing a set of conceptual and metaphysical tools—or, more ambitiously, an ontological framework—in order to account for central features of current fundamental physics. This article aims to review the main structuralist interpretative moves in the context of our two best fundamental physical theories of matter and spacetime, namely, quantum theory and general relativity. We highlight in particular the structuralist understanding of permutation (...) invariance, entanglement and nonlocality in quantum theory, and of the dynamical features of spacetime, diffeomorphism invariance and background independence in general relativity. To locate these papers' topic within a broader context, I begin with an overview of some prominent topics in the field of neurolaw, where possible providing some references to relevant literature. The specific questions asked by the three authors, as well as their answers and central claims, (...) are then sketched out, and I end with a brief comment to explain why this particular topic can be expected to gain more prominence in coming years. Uffink and Valente claim that there is no time-asymmetric ingredient that, added to the Hamiltonian equations of motion, allows to obtain the Boltzmann equation within the Lanford’s derivation. This paper is a discussion and a reply to that analysis. More specifically, I focus on two mathematical tools used in this derivation, viz. the Boltzmann–Grad limit and the incoming configurations. Although none of them are time-asymmetric ingredients, by themselves, I claim that the use of incoming configurations, as taken within the B–G (...) limit, is such a time-asymmetric ingredient. Accordingly, this leads to reconsider a kind of Stoßzahlansatz within Lanford’s derivation. (shrink)

In a world of glossy corporate social responsibility reports, the shallowness of the actual CSR results may well be its counterpart. We claim that the possible gaps between aspirations and implementations are due to the company's overrating abilities to deal with the irrational and complex moral world of business. Many academic approaches aim to lift business ethics up to a higher level by enhancing competences but will fail because they are too rationalistic and generalistic to match the pluralistic and situational (...) practice constituted by the mosaic of values and set of constraints. This is demonstrated by describing and analyzing the CSR development of the multinational caterer Sodexo and in particular its Dutch branch. We explain what they do and why they are not successful. We present a new tool named Ethical Room for Maneuver that centers experiences and concrete situations in a playground of inquiry and experiment to enhance abilities to operate in themoral world and to meliorate business and society with more effectiveness. While democratic societies experience intense conflicts about topics such as migration and climate action, there is no sound theory of democratic conflict. Agonistic theories emphasize the importance of conflict for democracy, but disregard conflict dynamics. Conflict sociology has focused on international or violent conflicts and neglects democratic conflicts. This article shows how this lacuna can be overcome. First, it develops an innovative, empirically informed processual approach to democratic conflicts. To this end, it draws on a broad range of scholarship from (...) sociology and social psychology, and integrates relevant insights into a processual framework for analyzing democratic conflicts that explores mechanisms of escalation, de-escalation, and reconciliation. Second, the article illustrates how this approach can ground a more elaborated democratic theory of conflict that concretizes how and when conflicts are beneficial to democracy, and explores the practices and institutions that democracies employ to cope with different conflict dynamics. The Politics of Human Rights provides an engaging and systematic introductory overview of the nature and development of human rights.

Nationalism has had a complex relation with the discipline of political theory during the 20th century. Political theory has often been deeply uneasy with nationalism in relation to its role in the events leading up to and during the Second World War. Many theorists saw nationalism as an overly narrow and potentially irrationalist doctrine. In essence it embodied a closed vision of the world. This article focuses on one key contributor to the immediate post-war debate—Karl Popper—who retained deep misgivings about (...) nationalism until the end of his life, and indeed saw the events of the early 1990s (shortly before his death) as a confirmation of this distrust. Popper was one of a number of immediate post war writers, such as Friedrich Hayek and Ludwig von Mises, who shared this unease with nationalism. They all had a powerful effect on social and political thought in the English-speaking world. Popper particularly articulated a deeply influential perspective that fortuitously encapsulated a cold war mentality in the 1950s. In 2005 Popper's critical views are doubly interesting, since the last decade has seen a renaissance of nationalist interests. The collapse of the Berlin wall in 1989, and the changing political landscape of international and domestic politics, has seen once again a massive growth of interest in nationalism, particularly from liberal political theorists and a growing, and, at times, immensely enthusiastic academic literature, trying to provide a distinctively benign benediction to nationalism. Many families of patients hold the view that it is their right to be present during a loved one's resuscitation, while the majority of patients also express the comfort and support they would feel by having them there. Currently, family presence is more commonly accepted in paediatric cardiopulmonary resuscitation than adult CPR. Even though many guidelines are in favour of this practice and recognise potential benefits, healthcare professionals are hesitant to support adult family presence to the extent that paediatric family (...) presence is supported. However, in this paper, we suggest that the ethical case to justify family presence during paediatric resuscitation is weaker than the justification of family presence during adult resuscitation. We go on to support this claim using three main arguments that people use in clinical ethics to justify FPDR. These include scarcity of evidence documenting disruption, psychological benefits to family members following the incident and respect for patient autonomy. We demonstrate that these arguments actually apply more strongly to A-FPDR compared with P-FPDR, thereby questioning the common attitude of healthcare professionals of allowing the latter while mostly opposing A-FPDR. Importantly, we do not wish to suggest that P-FPDR should not be allowed. Rather, we suggest that since P-FPDR is commonly allowed, so should A-FPDR. This is because the aforementioned arguments that are used to justify FPDR in general actually make a stronger case for A-FPDR. (shrink)

L'identité, dans les acceptions que ce terme revêt aujourd'hui, est une véritable énigme lexicale : elle désigne tout autant l'objet de contrôles sécuritaires policiers, un retour à la religion de ses parents, que, dans un guide touristique, la spécificité en voie de disparition d'un quartier. Reprenons. «Qui suis-je?», «Qui sommes-nous?», ce sont là ce qu'on appelle précisément des «questions d'identité». Nous comprenons spontanément de quoi il retourne parce que nous disposons d'un modèle : connaître l'identité de quelqu'un, c'est savoir comment (...) il s'appelle. Toutefois, lorsque la question de l'identité est posée à la première personne, mon intention n'est pas d'apprendre quels sont mes nom, prénoms et qualité, comme si je devais passer un «contrôle d'identité». Que signifie le mot dès lors qu'il est utilisé avec le possessif («mon identité», «notre identité») et qu'il ne désigne pas l'énoncé d'un état civil? Jadis le mot voulait dire exclusivement qu'il n'y a qu'une seule et même chose là où on aurait pu penser qu'il y en avait deux. Or, depuis quelques dizaines d'années, le mot a revêtu une signification autre, à savoir qu'il y a une chose ou un être qui possèdent la vertu d'être singulièrement eux-mêmes. Ainsi, que des guerres puissent éclater pour des questions qui ne relèvent pas strictement des intérêts matériels bien compris des antagonistes, nul ne saurait s'en étonner, sinon ceux qui nourrissent une conception utilitariste étriquée de l'être humain. En revanche, pourquoi est-ce le mot «identité» qui se trouve désormais chargé de signifier l'enjeu et l'objet de tels conflits? Tel est donc le point précis soulevé par Vincent Descombes : dans tout cela, que vient faire le mot «identit黠? Et que reste-t-il du concept d'identité? (shrink)

This paper centres on the question as to whether human rights can be reconciled with patriotism. It lays out the more conventional arguments which perceive them as incommensurable concepts. A central aspect of this incommensurability relates to the close historical tie between patriotism and the state. One further dimension of this argument is then articulated, namely, the contention that patriotism is an explicitly political concept. The implicit antagonism between, on the one hand, the state, politics and patriotism, and, on the (...) other hand, human rights, is illustrated via the work of Carl Schmitt. However, in the last few decades there has been a resurgence of interest in patriotism and an attempt to formulate a more moderate form, which tries to reconcile itself with universal ethical themes. Some of these arguments are briefly summarised; the discussion then focuses on Jürgen Habermas’s understanding of constitutional patriotism. This is seen to provide an effective response to Schmitt’s arguments. There are weaknesses in the constitutional patriotic argument which relate to its limited understanding of both the state and politics. This leads me to formulate my own argument for “unpatriotic patriotism.” The discussion then examines and responds to certain potential criticisms of this argument. (shrink)

Philosophical compatibilism reconciles moral responsibility with determinism, and some neurolaw scholars think that it can also reconcile legal views about responsibility with scientific findings about the neurophysiological basis of human action. Although I too am a compatibilist, this paper argues that philosophical compatibilism cannot be transplanted “as-is” from philosophy into law. Rather, before compatibilism can be re-deployed, it must first be modified to take account of differences between legal and moral responsibility, and between a scientific and a deterministic world view, (...) and to address a range of conceptual, normative, empirical and doctrinal problems that orbit its capacitarian core. Ciel noir, corps noir, trou noir, matière noire et énergie noire : pourquoi les physiciens éprouvent-ils le besoin de noircir certaines de leurs idées? Loin d'être anecdotique, cette interrogation permet de traverser l'histoire de la physique et d'en soulever une bonne part des enjeux actuels. L'énigme du ciel noir a préoccupé les astronomes pendant des siècles ; l'étude du rayonnement du corps noir est à l'origine de la révolution quantique ; le trou noir est une singularité cosmique fascinante ; la (...) matière noire et l'énergie noire sont des hypothèses mystérieuses de la cosmologie contemporaine. A partir de leurs disciplines respectives, l'astrophysicien Roland Lehoucq et le philosophe des sciences Vincent Bontems éclairent tour à tour la signification du qualificatif "noir" pour chacune de ces idées. Il ne s'agit donc pas d'un livre de vulgarisation classique, mais d'un dialogue où se répondent la signification scientifique de la couleur noire et la rêverie sur les métaphores ténébreuses. Dans le sillage de Gaston Bachelard, qui fut le premier à pratiquer ainsi en parallèle l'épistémologie et la psychanalyse de l'imaginaire, ces deux chercheurs proposent de manière complice une excursion dans les méandres de la recherche en alternant les éclairages critiques et émerveillés pour en dissiper l'obscurité.
